- Obtaining a County Court Judgement.
Our fixed fee debt recovery services offer a cost effective and stress free route to recovering money that is overdue to you. Our services include:
You can make a claim to the court if you are owed money which a debtor refuses to pay. The person or business who owes you money must respond to your claim within 14 days of receiving it. If the debtor admits to owing you money or does not respond to the claim, you can obtain a court order against them to pay the amount owed.
You may have a court hearing if:
- the person or business says they don’t owe you any money
- they disagree with the amount
- you can’t agree on how the money will be repaid
If you are the landlord and your tenant is in rent arrears, you will probably want to evict them. This is called seeking possession.
If you want to seek possession, you must first give written notice.
A notice does not always mean that the tenant will leave the property. In most cases you may have to get a court order before eviction and you can’t apply for a court order until the notice period has run out. The court order is called a possession order.
If the tenant does not leave by the date on the possession order, you will need to get a warrant of possession, allowing the bailiffs to come and evict them.
COMMERCIAL RENT ARREARS RECOVERY
Section 72 of the Tribunals Courts and Enforcement Act allows a commercial landlord to use Schedule 12 (taking control of goods) to recover rent payable under the lease from the tenant, without needing to go to court.
